Before using our website goldscale.com.sg all viewer /customer (“you”) are advised to read or ought to have read all our Terms & Conditions and Privacy Policy, so that you are aware of your legal rights and obligations with respect to Gold Scale Jewels Pte Ltd.

1 About our website and webservices

1.1 Gold Scale are offering one or more of the following web services (“Services”) on or through the WebSite (“Site”):

1.1.1 An online jewellery store for local market at the moment;

1.1.2 Access for customer to view our products and information, Services, pricing, graphics, images, videos, audio files, search engines and other types of works;

1.1.3 Blogs, message boards, communication tools or other social or interactive features, including the ability to post and share content with others;

1.1.4 Email or message alerts; and

1.1.5 Any other features, content or applications that Gold Scale may offer through the Site from time to time in our sole and absolute discretion.

1.2 By accessing this Site and/or using the Services, you hereby agree:

We are not responsible or liable for the content, functions, features, completeness, accuracy, legality, appropriateness or any other aspect of such Third Party Offerings and makes no guarantee, warranty or representation about such Third Party Offerings, including the standard or quality of any product(s) or service(s) sold through such Third Party Offerings. GOLDSCALE has no control over such Third Party Offerings and any Third Party Offerings provided should not be regarded as an endorsement or recommendation by GOLDSCALE. GOLDSCALE shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with any Third Party Offerings, and all such liability arising out of or in connection thereto is excluded to the maximum extent permitted by law.

4 Account Information

4.1 To access certain parts of the website, including to place orders through our Online Store, you will be required to sign-up for an account (“Account”) with GOLDSCALE and select a user name (“User Name”) and password (“Password”). You are required to provide accurate, complete, and up-to-date information required for your Account. You may at any time change or update your Account information by clicking here.

4.2 Users of this website are responsible for maintaining the confidentiality of your account and passwords, and for restricting access to your account. You are not allow to share or permit others to use your Account or Password; assign or transfer your Account to any other person or entity.

4.3 You shall be bound by and take full responsiblity for all purchases, communications and online activity transmitted or conducted through the use of your Account. GOLDSCALE shall not be in any way responsible and/or liable for any loss, damage, cost, expenses, or liabilities arising as a result of or in connection with the wrongful or fraudulent use of your Account. 5 About Order

5.1 Price and delivery charges shown on this website are for order and delivery in Singapore only. For oversea order and delivery, kindly email us for a quotation on the delivery service/ Charges, exchange rate and any other relevant charges.

5.2 Prior to submitting an order for any products and/or services listed on the Online Store (“Order”), you must sign in to your Account. To place an Order, please indicate the product(s) that you wish to order and the quantity required and provide all necessary information as may be required by GOLDSCALE at the Online Store.

5.3 After placing an online order, you will receive an e-mail from us acknowledging that we have received your order. Please take note that this email will only be an acknowledgement and Does Not constitute acceptance of your order.

5.4 All orders are subject to acceptance by GOLDSCALE. We will confirm such acceptance to you either during our telephone conversation ,email or other mode of communication. If we are unable to contact you based on the contact details provided, we reserve the right to terminate the order without any notice.

5.5 Until GOLDSCALE has indicated its acceptance of any Order by sending you an email confirming that the product(s) under the Order is ready for collection or have been dispatched, GOLDSCALE reserves the right to cancel, amend or reject your order in whole or in part for any reason at any time, including where any product is out of stock, damaged or any product service unavailable for any reason.

5.6 Processing of payment for an Order shall not in itself constitute acceptance of the Order by GOLDSCALE, provided that where an order is rejected or cancelled by GOLDSCALE, any payment made for such Order shall be reversed or refunded by GOLDSCALE in accordance with our prevailing refund policy at such time.

5.7 Please ensure that all information that you provide in your Order is accurate and complete. We will not be liable in whatever ways for any mistakes or errors caused by you, including any delivery by us to an address incorrectly keyed in by you.

5.8 If you discover that you have made a mistake with your Order after submission, please contact cimmediately. We will try our best to process your request. However, we cannot guarantee that we will be able to amend your order in accordance with your instructions, and the acceptance of any amendment to an order after it has been submitted shall be at the sole discretion of GOLDSCALE.

6 Price & Payment

6.1 Unless otherwise specified on our Site, prices displayed on the website are exclusive of applicable GST,VAT or any other applicable taxes, customs duties, charges and/or fees.

6.2 For Singapore delivery, delivery charges and GST will be added to your Order upon Check-out.

6.3 For Delivery outside of Singapore, we will email the quotation for your order after calculating the costs of insurance, taxes, delivery charges and/or other duties or fees that may be applicable. Unless otherwise indicated on the Site, any applicable insurance, taxes, charges, duties and/or fees shall be borne by you.

6.4 During the checkout process, you will be asked to enter your payment method and details. Payment for Orders may be made by way of eNets, Visa, MasterCard and any other credit or debit card issued by a credit or debit card company acceptable to Goldscale . GOLDSCALE reserves the right to change the payment options at any time for any reason.

7 Pricing & Product information

7.1 Our site contains a large number of product and it is always possible that, despite our best efforts, some of the product listed on our site may be incorrectly priced. GOLDSCALE reserves the right to correct any error in pricing or product information which may occur and shall not be liable for any error in the pricing and product information listed on our website or through our Services. The price to be paid by you for all products and/or services shall be based on GOLDSCALE’s current selling price on the date of receipt of the Order by GOLDSCALE, which may or may not be correctly reflected on the website.

7.2 If GOLDSCALE discovers an error in the price or specification of any item you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel and you have already paid for the goods, you will receive a full refund.

7.3 Each GOLDSCALE product are individually crafted by different craftsmen, slight variation of design may occur and will not be 100% identical to the image(s) shown on the website. These include but not limited to the size, shape and colour of all. Therefore, price of each identical item may have slight variation base on its actual weight.

7.4 The price of all 999 (24K) & 916 (22K) gold items are base on the daily gold price.

7.5 GOLDSCALE reserves the right to withdraw or cease to make available any or all products or services from the Online Store, or to change its prices or specifications of any product or service without liability or prior notice.

7.6 Delivery charges are not included in the product pricing. Delivery charges may vary from location to location and will be added to the final total cost.

7.7 Upon receiving your order, we may carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon receiving the authorization.

7.8 The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase.

8 Payment Option

Accepts all credit cards, Telegraphic transfer and bank transfer .

9 Tax Policy

In accordance with the Singapore’s Good and Service Tax (“GST”). GST shall appy to all goods sold and services rendered.

10 Promotions

10.1 GOLDSCALE may run promotion, contest and survey from time to time .

10.2 Promotion and contest are only valid for the period specified by GOLDSCALE.

10.3 Promotion apply to the use of credits, vouchers, coupons and codes (“Promo Codes”):

10.4 Each voucher, coupon and promo code is only eligible for a single use/redemption within the validity period.

10.5 Promo Code, voucher and coupon cannot be used in conjunction with any other promotion, voucher, coupon, code or offer, unless otherwise stated.

10.6 Vouchers, coupons and promo codes are non-replaceable if lost, stolen, destroyed, duplicated, tampered with or otherwise misappropriated or fraudulently used.

10.7 No refund, conversion or exchange to cash or credits is permitted.

11 Exchange and Return Policy

You are advise to inspect the goods immediately upon receiving or collecting them. GOLDSCALE will offer a replacement or refund of the manufacture defects or incorrect product(s), or arrange for the re-delivery and/or return of the incorrect product(s), in accordance with the prevailing GOLDSCALE returns policy.

11.1 sales after confirmed and sold are not refundable or exchangeable unless otherwise stated or specified below :
a. For any 999 Gold and 916 Gold items with manufacturing defect, an exchange of (i) 999 Gold and 916 Gold item or (ii) any jewellery item, for the same or higher value within 7 days from purchase date.

b. Jewellery item (18K or lesser) with manufacturing defect, an exchange with another jewellery item at the same or higher value within 7 days from purchase date.

c. For clause (a) & (b) above, you may exchange for a higher value item by paying the difference. In the event if the value of the exchange item is lower than the original purchased item, there will not be any refund of the excess amount.

11.1 After the first exchange of items under clause,

11.2 If the client wishes to exchange further, it will be treated as a trade-in item and will be transacted in accordance with the Trade code of Ethics and the Business Practice of Jewellery Industry.

11.3 To return a product, the product must be returned to GOLDSCALE in its original condition and unworn and unuse, together with the original accompanying invoice and packaging. GOLDSCALE reserves the right to refuse any claim if the claim does not meet any of the conditions, or falls within any of the exclusions, under the prevailing GOLDSCALE returns policy.

11.4 Diamond, jades, pearl and gemstone, 18K gold and below or special offer item jewellery are not returnable or not trading- in to the Goldscale.

11.5 Special orders item, engraved jewellery and all 999 Pure Gold ornament, products are final sale and not eligible for return and exchange. 999 Gold and 916 Gold item only be treated as a trade-in item.

11.6 To return a product, the product must be returned to GOLDSCALE in its original condition and unworn or unused, together with the original accompanying invoice and packaging. GOLDSCALE reserves the right to refuse any claim if:

a the claim does not meet any of the conditions, or

b falls within any of the exclusions, under the prevailing GOLDSCALE returns policy.

12 Comments, Feedback and Other User Generated Content

12.1 You may provide, submit or post comments, feedback, suggestions, photos, videos and other content or information (collectively, “User Content”) so long as the User Content is not illegal, criminal, immoral, inappropriate, hateful, obscene, defamatory, offensive, violent, abusive, political, religious, infringing or disrespectful in nature, and does not consist of or contain software viruses, solicitation or any form of “spam.” You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any User Content. You are solely responsible for your User Content.

12.2 GOLDSCALE reserves the right (but not the obligation) to review, remove or edit User Content. We do not regularly monitor and are not responsible for User Content, nor do we endorse any opinion contained in User Content. You further agree that we may use and publish your name in connection with such User Content.

13 Disclaimers & Limitations

13.1 While we make every effort to ensure that the Site, Services and all Content is accurate and complete, we provide the Site, Services and Content on an ‘as is’, ‘as available’ basis only without warranties of any kind either express or implied.

13.2 Unless expressly stated to the contrary to the fullest extent permitted by law, GOLDSCALE and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Goldscale.com.sg’s liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

14.1 We have the right to revise and amend these Terms and Conditions from time to time.

14.2 You will be subject to the Policies, Terms and Conditions in force at the time that you place your order with us, unless any change to those Policies, Terms and Conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those Policies, Terms and Conditions before we provide you with the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the Terms and Conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).

18 Notification of Infringement

18.1 GOLDSCALE reserves the right to investigate notices of copyright, trademark and other intellectual property infringement (“Infringement”) in respect of the Site, Services or Content (“Infringing Material”) and take appropriate action. If you believe that your work has been used or copied in a way that constitutes copyright infringement and such infringement is occurring on the Site or Services, please notify us in writing immediately in the form and containing the information prescribed by the Singapore Copyright Act (Cap. 63) (“Infringement Notice”).

18.2 GOLDSCALE will duly consider all Infringement Notices submitted in the above manner. In return, you agree that you shall not take any legal action or exercise any legal remedy you may have against us in respect of any Infringing Material, unless you have first given GOLDSCALE the Infringement Notice and sufficient opportunity to remove the Infringing Material, and thereafter we refuses or fails to remove the Infringing Material within a reasonable time. Where GOLDSCALE removes the Infringing Material in response to your Infringement Notice, you agree not to exercise and you hereby waive, any right of action against GOLDSCALE under applicable law which you may have in respect of any Infringing Material appearing on the Site prior to such removal.

18.3 You acknowledge and agree that GOLDSCALE has no control and cannot undertake responsibility or liability in respect of Infringing Material appearing on or through Linked Sites or other third party sites.

19 Indemnity

You agree to indemnify and hold GOLDSCALE, and its officers, agents, affiliates, partners, and employees, harmless from all claims, demands, actions, proceedings, liabilities (including statutory liability and liability to third parties), penalties, and costs (including without limitation, legal costs on a full indemnity basis), awards, losses and/or expenses, due to or arising out of:

19.2 your connection to the Site;

19.3 your breach of any terms and conditions of these Terms of Use;

19.5 your breach of any statutory requirement, duty or law.

20 Governing Law & Jurisdiction

20.1 These Terms of Use and all matters relating to your access to, or use of, the Site and the Services shall be governed by and construed in accordance with the laws of Singapore including without limitation the provisions of the Singapore Evidence Act (Chapter 97) and the Electronic Transactions Act (Cap. 88), without giving effect to any principles of conflicts of law.
